Terms and Conditions – Ticket Sales and Refunds (Online and Theatre Agency)

Description of Goods and Services Payable by Bank Card
Only tickets for performances from the repertoire of the Marin Sorescu National Theatre (TNCMS) can be purchased using a bank card

Terms and Conditions – Online Ticket Sales
(GDPR) represents Regulation (EU) 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing the Directive 95/46/CE./

“Personal data” means any information regarding an identified or identifiable natural person ("Data subject");

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

By purchasing a ticket using tncms.ro you agree to the following terms and conditions, which you are obliged to respect:
For events cancelled by the organizer
Online tickets:

  • Tickets purchased online may be exchanged or refunded only with the agreement of TNCMS, within a maximum of 7 days from the cancellation announcement. Tickets must be sent by email (as initially received) to organizare@tncms.ro, accompanied by a copy of the ID card, bank account number and bank name.

  • The approved refund will be made within 14 calendar days from the institution’s acceptance of the request, into the bank account provided by the applicant.

  • The return of the approved amounts will be made within a maximum of 14 calendar days from the acceptance of the application by the institution, to the bank account indicated by the applicant.

  • Bank or payment processor fees are not refundable.

Tickets purchased at the theatre agency:

  • Tickets must be returned only at the TNCMS agency, accompanied by a copy of the ID card, pension coupon (for pensioners), and student ID (for students/pupils).

  • The return of the approved amounts will be made within a maximum of 14 calendar days from the acceptance of the application by the institution, to the bank account indicated by the applicant.

  • Bank or payment processor fees are not refundable.


Cancellation by the spectator (for online tickets)

  • Tickets must be returned by email, as initially received, to organizare@tncms.rotogether with ID copy, bank account

  • If the spectator who purchased a ticket can no longer attend the performance for which the ticket was issued, he or she has the right to request a refund of the ticket value.

  • The request for a refund of the ticket price must be submitted in writing (by e-mail (for tickets purchased online or physically (for tickets purchased through the theater agency), at least 7 (seven) calendar days before the date of the performance.

  • Requests submitted after this deadline will not be accepted, and the ticket value will not be refunded.

  • The return of the approved amounts will be made within a maximum of 14 calendar days from the acceptance of the application by the institution, to the bank account indicated by the applicant.

  • Bank or payment processor fees are not refundable.

  • tncms.ro is not responsible for actions not related to the ticket sales procedure;

  • tncms.ro cannot be accused of entering the event with counterfeit tickets;

  • make sure you arrive at the event in good time so that you can enter the venue before the starting time indicated on your ticket. The organizer reserves the right to deny access if the event has already started;

  • if tickets purchased from tncms.ro will be resold or transferred for the purpose of obtaining material advantages by a third party not authorized by tncms.ro, the show organizer, the agents responsible for supervising the location may refuse the ticket holders' participation in the event, including their evacuation from the location;

  • unless otherwise specified, the ticket is valid for access by a single person to a performance of the event mentioned on the ticket;

  • the show organizer has the right to change the event dates, with new information being announced through specific means of communication;

  • this ticket cannot be given as a prize in any contest without the prior consent of the show organizer;

  • tncms.ro is not responsible for damages caused by third parties to any holder of a ticket purchased through tncms.ro;

  • Access to events with alcoholic beverages, drugs, dangerous substances, glass containers, cameras and video cameras, blunt objects and weapons of any kind is prohibited; ticket holders may be checked upon entering the venue to ensure compliance with the announced rules;

  • the use of drugs or other illegal substances in the location where the event is taking place constitutes a crime and will be punished according to the legal provisions in force;

  • restrictions apply in accordance with laws and regulations on the protection of minors;

  • "Purchasing the ticket implies that you agree to the terms and conditions displayed on the tncms.ro website, terms and conditions that you are obligated to respect."

The ticket will be delivered directly to your email inbox (to the email address specified at the time of booking), immediately after payment confirmation. You can print your electronic ticket for the show yourself or show the ticket received by email at the entrance.

What information do we collect?
1. Information you voluntarily provide to us
When you access online tickets on the site, when you contact us by phone or email or communicate with us in any way, you voluntarily provide us with information that we process. This information includes your name, surname, email address and telephone number. When you subscribe to the newsletter, you voluntarily provide us with your email address. By providing us with this information, we keep it secure and confidential in our database. We do not disclose or transfer information to third parties.

When you browse our website, we may collect information about your visit to the website. This information may include your IP address, operating system, browser, browsing activity, and other information about how you interact with the website. WHAT IS THE LEGAL BASIS FOR THE PROCESSING?
Regarding the data you voluntarily provide us by creating an account, by purchasing a subscription, the data we collect automatically through the use of cookies or other similar technologies, the basis for processing is consent. By accessing the site, you validly give your consent to the processing of your data.

TO WHOM DO WE DISCLOSE YOUR INFORMATION?
We will not disclose your information to third parties, for their own marketing or commercial purposes. However, we may disclose your information to the following entities:
• Service providers. Putem dezvalui informatiile tale altor companii care ne furnizeaza servicii si actioneaza in calitate de persoane imputernicite, cum ar fi companiile care ne ajuta pentru facturare sau care trimit e-mailuri in numele nostru. Aceste entitati sunt selectate cu o grija deosebita pentru a ne asigura ca indeplinesc cerintele specifice in materie de protectie a datelor cu caracter personal. Aceste entitati au o capacitate limitata de a utiliza informatiile tale in alte scopuri decat cel de a ne furniza servicii;
• Instante de judecata, parchete sau alte autoritati publice pentru a ne conforma legii sau drept raspuns la un procedura legala obligatorie (cum ar fi un mandat de perchezitie sau o hotarare judecatoreasca);
• Altor parti cu consimtamantul sau la instructiunile tale. In afara dezvaluirilor descrise in prezenta Politica de confidentialitate, este posibil sa transmitem informatiile tertilor carora consimti sau soliciti sa efectuam o asemenea dezvaluire.

TRANSFERAM DATE CATRE STATE TERTE?
In prezent, nu transferam datele tale catre state din afara Uniunii Europene. Daca vom schimba politica, te vom informa in mod corespunzator, iti vom prezenta garantiile aferente si iti vom solicita consimtamantul.

CARE SUNT DREPTURILE TALE?
• Dreptul de retragere a consimtamantului;
In situatia in care prelucrarea se bazeaza pe consimtamant, iti poti retrage consimtamantul in orice moment si in mod gratuit prin transmiterea unui e-mail pe adresa secretariat@tncms.ro cu subiectul „retragere consimtamant”.
• Dreptul de a depune o plangere in fata unei autoritati de supraveghere;
• Dreptul de a te adresa justitiei;
• Dreptul de acces;
Ai dreptul de a obtine din partea noastra o confirmare ca se prelucreaza sau nu date cu caracter personal care te privesc si, in caz afirmativ, ai dreptul de acces la datele respective.
• Dreptul la rectificare;
Ai dreptul de a obtine de la noi, fara intarzieri nejustificate, rectificarea datelor cu caracter personal inexacte care te privesc. Tinandu-se seama de scopurile in care au fost prelucrate datele, ai dreptul de a obtine completarea datelor cu caracter personal care sunt incomplete, inclusiv prin furnizarea unei declaratii suplimentare.
• Dreptul la stergerea datelor („dreptul de a fi uitat”);
In situatiile in care datele nu mai sunt necesare pentru indeplinirea scopurilor, s-a retras consimtamantul si nu exista un alt temei juridic pentru prelucrare, te opui prelucrarii si nu exista motive legitime care sa prevaleze in ceea ce priveste prelucrarea sau datele cu caracter personal au fost prelucrate ilegal, ai dreptul de a obtine stergerea datelor care te privesc, fara intarzieri nejustificate.
• Dreptul la restrictionarea prelucrarii;
Ai dreptul de a obtine din partea noastra restrictionarea prelucrarii in cazul in care se aplica unul din urmatoarele cazuri:
(a) contesti exactitatea datelor, pentru o perioada care ne permite noua sa verificam exactitatea datelor;
(b) prelucrarea este ilegala, iar tu te opui stergerii datelor cu caracter personal, solicitand in schimb restrictionarea utilizarii lor;
(c) nu mai avem nevoie de datele cu caracter personal in scopul prelucrarii, dar tu ni le soliciti pentru constatarea, exercitarea sau apararea unui drept in instanta;
(d) te-ai opus prelucrarii in conformitate cu articolul 21 alineatul (1) din GDPR, pentru intervalul de timp in care se verifica daca drepturile noastre legitime prevaleaza asupra drepturilor tale.

• Dreptul de a nu face obiectul unei decizii bazate exclusiv pe prelucrarea automata, inclusiv crearea de profiluri, care produce efecte juridice care te privesc sau te afecteaza in mod similar intr-o masura semnificativa
Nu ai acest drept in cazul in care decizia:
(a) este necesara pentru incheierea sau executarea unui contract intre tine si un operator de date;
(b) este autorizata prin dreptul Uniunii sau dreptul intern care se aplica operatorului si care prevede, de asemenea, masuri corespunzatoare pentru protejarea drepturilor, libertatilor si intereselor legitime ale persoanei vizate; sau
(c) are la baza consimtamantul tau explicit.

The user accepts that the data provided by him/her will be processed electronically by TNCMS, the user agrees that his/her data will be used within the limits imposed by Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and Law no. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, following the procedures for compliance with Regulation no. 679/2016 (General Data Protection Regulation). The user is informed that this consent may be revoked at any time.
